Mini Betta Aquariums Under 1.5 Gallons
Mini betta aquariums under 1.5 gallons cannot adequately and healthily provide long term housing for a betta fish.[1] Mini betta aquariums under 1.5 gallons cause betta fish to suffer in ways they would not otherwise suffer in a larger aquarium.[2] Mini betta aquariums under 1.5 gallons cause betta fish to die much earlier than they would otherwise die in a larger aquarium due to fish ammonia excretion.[3]
Defendant knows that mini betta aquariums under 1.5 gallons cannot adequately and healthily provide long term housing for a betta fish but defendant continues to sell these types of aquariums for this purpose solely to generate profits. Ms. Gray and members of the putative class would not have purchased a mini betta aquarium under 1.5 gallons from defendant if they had known that they could not be used to adequately and healthily provide long term housing for a betta fish.
